Terms & Conditions of Sales

1. Scope
These terms apply to all services provided by Press Your Beat (“PYB”), including but not limited to coordination of manufacturing, mastering, design, printing, packaging, and logistics. By placing an order or making a payment, the customer acknowledges and accepts these terms.

2. Definitions
– “Client” means Press Your Beat’s customer.
– “Parties” refers to Press Your Beat and the Client.
– “Contract” means the sales contract concluded between the Parties subject to these general terms.
– “Service” refers to any service performed by PYB for the Client (e.g., mastering, pressing, printing, packaging).
– “Product” refers to the finished goods delivered to the Client.
– “Recordable Media” refers to formats such as CDs, vinyl, or cassettes.

3. Orders and Execution
Production begins only after full payment, submission of all required files and documentation, and confirmation from the plant that the order has been scheduled. PYB is not responsible for slot allocation until official confirmation is received. The Contract is considered binding upon confirmation of the quote, signature of the Contract, or written acceptance.

PYB is entitled to refuse the acceptance of files not made in accordance with the specifications provided. Any additional work on client’s materials for the purpose of compliance with specifications may be considered as an additional service of technical department and will have an extra charge of €45.

4. Files and Revisions
Clients must supply production-ready files following technical specifications. PYB reserves the right to reject non-compliant files. Up to two preview revisions are included. Additional changes will be charged at €35 per revision. PYB may reformat or adjust files at the client’s cost if necessary.

5. Lead Times and Delivery
Estimated lead times are: Vinyl: 8–9 weeks; CD: 4–5 weeks; Cassette: approx. 5 weeks. These estimates are not binding. Delays from suppliers or transporters do not entitle clients to compensation or cancellation. Risk transfers to the Client upon dispatch from the factory (EXW Incoterms® 2020, Boleslaw, Poland).

6. Tolerances
Due to manufacturing constraints, delivered quantities may vary by ±10%. Surplus units will be invoiced; shortages will be refunded. Clients must supply +10% extra printed materials to account for potential production losses. Minor imperfections (e.g., label shifts, color variations) that don’t affect playability or usability are not considered defects.

7. Quality Standards
PYB ensures internal quality checks. Products must be playable from start to finish, with no stylus skipping or audible defects. Test pressings and Cromalins are references for sound and print, respectively. Cosmetic flaws that don’t affect usability are excluded from warranty claims.

We work to offer the best production deadlines, however these may vary for different reasons, so we are not responsible for any delays communicated by our suppliers.

8. Prices and Taxes
Quotes exclude VAT, customs, or local taxes. These are the Client’s responsibility. Prices may change without prior notice unless confirmed in writing. In case of cancellation after confirmation, all incurred costs (e.g., mastering, test pressings) will be invoiced.

9. Payment Terms
Payment must be made by bank transfer as per the invoice deadline. Late payments incur 12% annual interest and a €40 fee per invoice. Persistent non-payment may lead to order suspension or contract termination. Storage fees (2% per day of the order value) may apply for delayed pickups.

10. Ownership and Risk
Ownership transfers to the Client only after full payment. PYB retains the right to reclaim products in case of non-payment. Positive metal stampers may be provided upon request; otherwise, they are discarded after 3 months.

11. Claims and Complaints
Visible damage or quantity discrepancies must be reported within 72 hours. Hidden defects must be reported within 30 days (or 3 months for runs >1000 units). Claims must be documented with photos, quantity, affected titles, and samples. If unjustified, inspection costs may be charged.

12. Warranty and Liability
Defective goods will be repaired or replaced at PYB’s discretion. Liability is limited to the value of the defective items. PYB is not liable for indirect or consequential damages such as lost revenue or reputation. No claims are accepted for unauthorized modifications, improper storage, or misuse.

13. Intellectual Property
Clients certify they hold all necessary rights for duplication. PYB is not liable for third-party claims related to copyright. Clients agree to indemnify PYB from all related legal issues.

14. Force Majeure
PYB is not liable for delays or failures due to causes beyond its control, such as strikes, epidemics, wars, supplier issues, or natural disasters.

15. Promotional Use
Unless otherwise stated in writing, PYB may showcase finished products for promotional purposes on its website or social media.

16. Data Protection
All personal data is handled in compliance with GDPR and used strictly for order processing and communication. Data will not be shared or sold beyond what is necessary for fulfilling services. Clients may contact contact@pressyourbeat.com for data-related requests.

17. Applicable Law and Jurisdiction
These terms are governed by Spanish law. Any disputes shall be submitted to the courts of Valencia, Spain. Mediation is encouraged before initiating legal proceedings.

18. Additional Notes
The total amount may vary depending on the units obtained in the production process (approx. 10% +/-). Surplus will be billed and shortages refunded. Storage of unused client-supplied materials is limited to 3 months; after this period, they may be discarded unless otherwise requested in writing.4
